A man has been sentenced to six years in prison after admitting to raping his 14-year-old stepdaughter, resulting in the child becoming pregnant.
According to Wadadli Case Files, the sentence was handed down by Justice Ann Marie Smith in the High Court on Friday after the accused pleaded guilty to a charge of sexual intercourse with a stepchild. The man’s identity has been withheld to protect the identity of the victim.
The court heard that the offence occurred between July and August 2021 when the accused, who was 37 years old at the time and married to the girl’s mother, engaged in sexual intercourse with his teenage stepdaughter, who was 14 years old at the time. The abuse led to the girl becoming pregnant.
The matter came to the attention of authorities in November 2021 after the victim’s school reported the pregnancy to police.
During the investigation, the complainant initially provided investigators with false information regarding the identity of the child’s father. However, those claims were later disproved as the investigation progressed.
The accused was intercepted by police at the airport in December 2021 while attempting to leave the country. At the time, he denied any knowledge of who had fathered the child.
Following the birth of the child in March 2022, investigators sought DNA samples from both the mother and baby. The court heard that the victim’s mother initially refused to cooperate with the process but later consented. Police were also required to obtain a court order to secure a DNA sample from the accused.
DNA testing conducted in Jamaica later confirmed that the accused was the biological father of the child.
He was subsequently arrested and formally charged in April 2023.
In imposing sentence, Justice Smith highlighted several aggravating factors, including the offender’s abuse of a position of trust, the 23-year age difference between him and the victim, and the fact that the offence resulted in pregnancy.
The judge determined that the seriousness of the offence warranted a starting point of just under 10 years’ imprisonment.
Although the accused received credit for pleading guilty, the court granted a reduction of one-sixth rather than the one-third discount typically afforded to defendants who enter guilty pleas at the earliest opportunity. The reduced discount reflected the fact that the plea was only entered on the morning the trial was scheduled to begin.
The court ultimately sentenced the man to six years in prison.
